In order to gain regulatory approval from the Washington Public Utilities Commission to provide interLATA toll service in the state of Washington, the Regional Bell Operating Company (Qwest) must demonstrate that it meets each of the checklist items contained in Section 271(c) of the Telecommunications Act of 1996. Also, under Section 252(f)(1) of the Act, Qwest may submit to the Commission "a statement of terms and conditions that such company generally offers within that State to comply with the requirements of Section 251 and the regulations thereunder and the standards applicable under this section. (SGAT)

The Washington PUC resolved to determine whether Qwest was worthy of 271 approval through a series of workshops, each devoted to a different set of checklist items and the provisions of the SGAT which addressed those items. The first of these workshops was held on June 21-23, 2000. This workshop set out to resolve issues pertaining to Checklist Items No. 3 (Poles, Ducts, Conduits, and Rights-of-Way), 7 (911/E911, Directory Assistance and Operator Service), 8 (White Pages Listings), 9 (Numbering Administration), 10 (Signaling and Associated Databases), 12 (Dialing Parity), and 13 (Reciprocal Compensation). The second workshop, held on November 6-9, and 10, 2000, addressed the issues of Checklist Items No. 1 (Interconnection and Collocation), 11 (Number Portability), and 14 (Resale). Twenty-six intervening parties took part in these workshops, many of whom filed briefs with the Commission regarding Qwest's compiance, or non-compliance, with the issues at hand.

After a period of months filled with discussion and debate, the Commission found that Qwest's SGAT did not demonstrate full compliance will checklist items 1, 11, and 14. For instance, in order to ensure adequate interconnection, the Commission mandated that Qwest, among other things, allow CLECs to use entrance facilities and mid-span meets for interconnection and to obtain nondiscriminatory access to UNEs at any technically feasible point of interconnection chosen by the CLEC. To bring Qwest in compliance with item 11, the Commission ordered it to allow CLECs the option of using the coordinated cutover process or managed cutover process when provisioning CLEC provided loops and porting numbers. And to ensure compliance with item 14, Qwest was ordered to modify its SGAT so that it included language prohibiting Qwest from using for marketing purposes any information received during a CLEC request for subscriber information or ordering.

Additionally, Qwest was required to submit to the Commission the audited results of performance testing relating to Checklist Items No. 1, 11, and 14, and associated testimony concerning the audited results as soon as the results are available. The Commission would not find Qwest in compliance with Checklist Items No. 1, 11, and 14 until after its review of the results.

US West, Washington's largest local telephone company, requested rate restructuring that would lower some business and toll rates but raise residential rates over four years to $21.85 per month in urban areas and $26.35 per month elsewhere. The Commission rejected the Company's requested increases, rejected its cost study, and directed it to file tariffs to effect a decrease in rates of $91.5 million. The WUTC accepted the Hatfield Model cost study for purposes of evaluating the costs of local exchange service. USWC is directed to improve customer service quality. While the Company's authorized rates will be based on the lowest reasonable rate of return, the Company may petition to have its rate of return restored to mid-range once it can demonstrate that its service quality has significantly improved. USWC is directed to file a general resale tariff.
