Order Addressing Collacation Issues
In this order, the Commission attempts to resolve specific, generic issues involving collocation in the hopes that such a resolution will allow it to effectively and efficiently participate in establishing State collocation standards or rules. An investigation into these issues was commenced at the request of a handful of CLECs due to widespread problems they had faced in obtaining collocation space from the incumbent local exchange companies (ILECs) in North Carolina. The Commission issued 63 findings of fact. These included appropriate filing requirements, Commission jurisdiction, payment obligations, application parameters, provisioning timetables, definition clarifications, reporting requirements, and rate issues including Rate for Floor Space, Construction of a Cage, DC Power, Rates for Cross-connects, and Adjacent Collocation. The bulk of the order contains evidence and conclusions for the various findings of fact.
In this matter, the Commission ruled that, among other things, no later than January 28, 2002, the Parties jointly file a Standard Offering modified pursuant to the Commission’s conclusions in the order and that BellSouth, Carolina/Central, and Verizon refile their cost studies and resulting rates no later than that same day.

On May 8, 1997, the Federal Communications Commission (FCC) released a Report and Order in CC Docket No. 96-45 (Universal Service Order or USO) in response to Section 254 of the Telecommunications Act of 1996 (the Act). In this Order, the FCC asked the states to elect, by August 15, 1997, whether they would conduct their own forward-looking economic cost (FLEC) studies for the purpose of determining federal universal service support for nonrural eligible carriers' rural, insular, and high cost areas.
On August 12, 1997, the Commission issued an Order electing to conduct its own FLEC study for submission to the FCC and notifying the FCC of its election. The Commission also adopted a timetable, which was modified by subsequent Orders, for developing North Carolina FLEC studies. The timetable included dates for filing proposed studies, supporting testimony and documentation, and for holding evidentiary hearings.
