On February 27, 1996, AT&T Communications of Illinois, Inc. sent a letter to Ameritech Illinois requesting negotiations under Sections 251 and 252 of the 1996 Act to establish an agreement regarding the rates, terms, and conditions for interconnections and other arrangements leading to the provisioning of intraMSA service by AT&T.

On August 1, 1996, AT&T filed a petition for arbitration with the Illinois Commerce Commission seeking arbitration of an entire interconnection agreement with Ameritech under Section 252(b) of the 1996 Act. On August 2, 1996, Ameritech filed a petition to arbitrate three additional open issues with AT&T which Ameritech had raised in negotiations and which AT&T had failed to present for arbitration in its petition. These two petitions were consolidated and are considered here under the guise of a single contract to which the parties have submitted proposed language for all unresolved provisions.
