In the July 8, 1998 Decision in Docket No. 98-02-01, the Department of Public Utility Control concluded that making a limited set of bundled unbundled network elements offerings, available to qualified certified local exchange carriers for their use was not in conflict with strictures contained in the Telecommunications Act of 1996 and was in the interest of promoting local exchange competition.

On March 3, 1999, under order of the Department, Bell Atlantic New York (BA-NY) filed a limited set of proposed tariff offerings for these bundled unbundled network elements (UNEs).
After review of the Company's proposed tariff, the Department found that for the most part, BA-NY's provision of UNE combinations is in compliance with the requirements set forth by the FCC and the Department. While conceding this fact, the Department required BA-NY to provide through interconnection agreements, all UNE combinations that are technically feasible, which are currently offered in New York and are not included in the proposed Connecticut tariff. These combinations will be offered under the same terms and conditions as in New York and new CLEC-requested combinations that are currently deployed in BA-NY's network will be offered as quickly as possible.

In making this ruling, the Department accounted for arguments from Worldcom and Sprint regarding BA-NY's failure to provide the combinations that CLECs require to effectively and efficiently provide facilities-based local exchange service in Connecticut. As a result, it required these CLECs to file five potential UNE combinations that the CLECs require to be tariffed for provision of local exchange service.

Lastly, regarding the proposed UNE rates, the Department determined it appropriate to adopt for Connecticut the rates and charges approved by the New York Public Service Commission and that the proposed tariff will only be applicable to residential and small business for a period of five years.

Final Award for an Agreement for Network Interconnection and Resale Between the Southern New England Telephone Company And AT&T

This arbitration was sought on August 9, 1996 by AT&T pursuant to 47 U.S.C. 252 and Title 16 of the Connecticut General Statutes. AT&T initially sought to arbitrate 30 issues dealing with resale, unbundled network elements and interconnection, pricing and operational issues. A procedural order was issued by the Arbitrator on October 7, 1996. AT&T and the Southern New England Telephone Co. were designated parties in the matter.

This award is subject to being reopened by the arbitrator should the appeal against the Federal Communication Commission interconnection order in CC Docket 96-98 be successful.

The DPUC initiated this docket to provide the opportunity for full and fair examination of infrastructure issues from a broad perspective. The Department examines what responsibilities regarding telecommunications infrastructure should be imposed on non-LEC participants in Connecticut's telecommunications markets as well as to review certain LEC infrastructure issues in the increasingly competitive telecommunications environment. The Department established a scope of directed inquiry involving a three-step process (position paper, comments and reply comments). The Department issued a Draft Decision in this docket on July 11, 1996. All participants had the opportunity to file written comments and to present oral argument on the Draft Decision.
