Pacific Bell/Request to Provide Integrated Pathway Service, a New Service, as a Catagory III Service

This Resolution approves Pacific Bell's (Pacific) request to offer Integrated Pathway Service (IPS), a channelized (1.544 Mbps) high capacity service which delivers up to 24 channels of DS-0 (64 Kbps) level data/and or exchange voice connecting service. We also grant Pacific's request to offer IPS as a Category III service in view of the fact that similar services have been available to consumers from a number of providers. We believe that allowing Pacific to offer Integrated Pathway Service as Category III service will enable Pacific to compete with providers of IPS-type services who have already established themselves in the marketplace. In addition, the maximum pricing flexibility accorded to a Category III service will give Pacific the flexibility to offer competitive pricing strategies that will also benefit the consumers.

THEREFORE, IT IS ORDERED that: 1. Pacific Bell is authorized to make effective Advice Letter No. 19804 and Supplement A. 2. The protests filed by the California Cable Television Association on behalf of itself, Time Warner Telecom of California, L.P., AT&T Communications of California, Inc. and ICG Telecom Group, Inc. are denied. 3. Advice Letter No. 19804, its supplement and the associated tariff sheets, shall be marked to show that they are authorized by Resolution T-16302.

On March 31, 1998, Pacific Bell (Pacific) filed a draft application with the California Public Utilities Commission (Commission or CPUC) to become a long distance provider pursuant to Section 271 of the Telecommunications Act of 1996 (the Act or the TA96). The submitted draft was in response to this Commissionís requirement that it receive a draft application at least 90 days in advance of any filing with the Federal Communications Commission (FCC). The Act requires the FCC to consult with the relevant state commission concerning compliance with Section 271; the FCC, however, makes the final determination.

This Final Staff Report (FSR) is the second major report produced by the Commissionís Telecommunications Division staff in its evaluation of Pacificís current draft application. The FSR provides a comprehensive list of corrective actions most likely to aid Pacific in complying with Section 271 requirements. Pacific has stated that it intends to work with staff and parties to determine solutions to the problems raised in the 271 process. To that end, Pacific should make a compliance filing, sometime in the future, with this commission. Any compliance filing should include data proving Pacificís compliance with issues identified in this report. In any case, Pacific has not yet filed its application with the FCC. By this order, the California Public Service Commission institute a rulemaking to modify the Universal Lifeline Telephone Service (ULTS) program and General Order (GO) 153. The specific modifications they shall consider in this proceeding are as follows: (1) Whether to update GO 153 to reflect changes to the ULTS program that have occurred since GO 153 was adopted in 1984; (2) Whether to revise the ULTS program to conform with federal universal service programs; (3) Whether to revise the ULTS program to foster competition in the provision of ULTS; and (4) Whether to adopt uniform procedures for use by telecommunications carriers in complying with ULTS program requirements. Their purpose in considering the aforementioned modifications to the ULTS program and GO 153 is to increase the number of low-income households that have access to affordable basic telephone service; and to enhance the efficiency and effectiveness of the ULTS program.
