With this Order, the Commission requests applications to provide Telecommunications Relay Service (TRS) in Alaska and establishes a schedule for the consideration of submitted applications. The proceeding was initiated as a result of the adoption of amended regulations governing the provision of TRS in Alaska. The new regulations adopted new federal TRS standards and modified the method the Commission used to select and regulate the TRS provider for Alaska. This Order serves to implement the second of these changes.

Under previous TRS rules, a single TRS provider was certificated on a permanent basis with the TRS provider’s revenue requirement reviewed annually. That provider is currently GCI Communication Corp which began serving customers in June of 1992. Under the new regulations, the selection process will be repeated approximately every five years with TRS rates being reviewed during that selection process.

In this Order, the Commission sets down the following basic requirements for applicants seeking to provide TRS in Alaska. The applicant must have:
1) The ability to meet or exceed federal requirements concerning all operational, technical, and functional minimum standards for TRS contained in 47 C.F.R. § 64.604, as revised June 30, 2000; and
2) That it has established the following procedures:
a) Solicit input from users of the service and carriers whose customers use TRS;
b) Fairly and expeditiously resolve customer complaints;
c) Develop and implement community outreach and education services and programs; and
d) Provide for TTY equipment distribution to customers.

The Commission will evaluate all applications on the basis of:
1) price proposed for basic TRS expressed in dollars and cents per billable minute [40 percent];
2) quality of service, which includes the requirements set out in 3 AAC 52.020(e) [40 percent]; and
3) availability of, and price for, optional services and ability to meet or exceed any criteria specified in this Order [20 percent].

According to the procedural schedule outlined in this Order, carriers have until July 18, 2001 to submit their applications to provide TRS.

On October 23, 2000, WorldCom, Inc. ("WorldCom"), and Intermedia Communications, Inc. ("Intermedia"), jointly filed with the Commission an application for approval of a transaction whereby WorldCom would acquire, in a stock-for-stock transaction, a controlling interest in Intermedia. This interest would include its Intermedia's operations in Alaska as reseller of intrastate interexchange telecommunications services.

After reviewing a Staff report that deemed WorldCom fit to provide intrastate interexchange service in Alaska, the Commission found that tangible benefits would result from the transaction. It also felt that any risk involved in the transfer could be mitigated by placing conditions on the transfer.

The Commission approved the joint application contingent, first, upon the consummation of the transaction. Second, approval would be subject to the condition that within thirty days of completing the transaction to acquire controlling interest in Intermedia, WorldCom would be required to inform the Commission of the actual date of the transfer. And third, Intermedia would be granted a waiver of the requirement to file a tariff of its own because Intermedia’s name will remain unchanged as a result of this transaction.

The Commission stated that its standard for evaluating applications of this type is whether the proposed transfer/acquisition is affirmatively consistent with the public interest. In this case, it carefully considered the evidence presented in the proceeding, including Staff’s recommendation, and it concluded that, as a result of its ruling, its own standard would be upheld.

On July 29, 1996, GCI Communication Corp. filed a petition for arbitration under Section 252 of the Telecommunications Act of 1996 with the MUNICIPALITY OF ANCHORAGE d/b/a ANCHORAGE TELEPHONE UTILITY a/k/a ATU TELE-COMMUNICATIONS for the purpose of instituting local exchange competition. On August 23, 1996, ATU filed a reply to GCICC's petition.

On September 6, 1996, GCICC filed a motion for appointment of an arbitrator and for a prehearing conference. On September 12, 1996, ATU filed its reply to that motion.

The Commission has reviewed the filings made in this proceeding and has determined that the Commissioners will act as final arbitrators in the arbitration process for interconnection of ATU and GCICC as local exchange carriers under the Act. To accomplish the final arbitration, the Commission will select an individual to act as a primary arbitrator to develop a recommended decision.
