On September†30, 1997, Consumers Energy Company (Consumers) filed an application requesting approval of its power supply cost recovery (PSCR) plan and factors for 1998. In the February†11, 1998 order in Case No. U-11290 et al., the Commission approved Consumersí proposal to suspend its PSCR clause immediately, to replace the current PSCR factor of $0.00285 per kilowatt-hour (kWh) with an interim base rate adjustment of $0.00270 per kWh, and to terminate the 1998 plan case. Therefore, on February†17, 1998, Consumers filed a motion to terminate this plan case. On March†4, 1998, Administrative Law Judge Daniel E. Nickerson, Jr., issued a Proposal for Decision recommending that the Commission terminate the case. On March†18, 1998, the Residential Ratepayer Consortium (RRC) and Attorney General Frank J. On September 30, 1996, The Detroit Edison Company (Detroit Edison) filed an application requesting authority to implement a power supply cost recovery (PSCR) plan and factors for 1997, pursuant to 1982 PA 304 (Act 304), MCL 460.6h et seq.; MSA 22.13(6h) et seq. As required by Act 304, it also filed a five-year forecast of power supply requirements, sources, and costs. At a prehearing conference on November 4, 1996, Administrative Law Judge James N. Rigas (ALJ) granted leave to intervene to Attorney General Frank J. Kelley (Attorney General), the Association of Businesses Advocating Tariff Equity (ABATE), and the Residential Ratepayer Consortium (RRC). The Commission Staff (Staff) also participated in the case.

After preliminary proceedings, the Commission issued an order on December 12, 1996 granting Detroit Edison’s request to adjourn proceedings on the five-year forecast. On July 31, 1997, the Commission issued an order requiring that proceedings on the five-year forecast resume. In response to that order, only Detroit Edison filed testimony and exhibits.
