On January 8, 2001, the Coalition of California Utility Employees (CCUE) filed an emergency motion to prevent Pacific Gas and Electric Company (PG&E) and Southern California Edison Company (SCE) from laying off workers until the Commission had a full opportunity to review the companies' proposals. The Commission expressed concern about whether the layoffs and cost cutting measures affected the utilitiesí provisioning of adequate, efficient, just, and reasonable service that are necessary to promote the safety, health, comfort, and convenience of its customers, employees, and the public. After holding hearings on the matter, the Commission determined that most of the layoffs that had already occurred affected contractors, hiring hall employees, and temporary and part-time workers and that the proposed layoffs by SCE and PG&E in the upcoming months would affect the same category of workers that have already been laid off.

Through its inquiry, the Commission found that the layoff of these workers had already adversely affected the companies' transmission and distribution operations, the call centers, meter reading, and the number of personnel who could respond to large scale outages. SCE and PG&E provided evidence that their layoffs would degrade the level of service in certain areas, including: lengthening the time for providing connections to new customers; lengthening the time for restoring service in the event of an outage or non-emergency service problem; providing actual meter reads on a bi-monthly basis and estimated usage in the other months; and lengthening the average speed of answer time for the utilitiesí customer call centers. In the end, the Commission determined that the companies' cost cutting measures which reduce the ability of call center operators to answer calls, and of field personnel to respond to outages and to restore service in a timely manner, do not maintain a level of adequate, efficient, just and reasonable service for consumers.

As a result of its findings, the Commission ordered SCE and PG&E to rescind the layoffs that they had already implemented, or were in the process of implementing, to the extent that the positions that were terminated adversely affect the respective utilityís ability to: fully staff their customer call centers; read meters on a monthly basis for all customers; timely respond to service calls and outages; and to connect new customers. Further, the companies were directed to staff their customer call centers so that they can handle the volume of incoming calls, and to staff their T&D units so that field personnel can continue to connect new customers and respond to and remedy outages and other service-related problems in the same amount of time that existed prior to the utilitiesí financial problems.

The companies were barred from making any further layoffs which adversely affected their ability to provide service and were required to file with the Docket Office, and provide the Commission and the parties to this proceeding, with a monthly update regarding their cost cutting measures.

The Commission concludes that competing energy service providers should be allowed to present consolidated bills that reflect the full cost of providing service. Also established is that energy service providers that utilize consolidated billing are responsible for all payments, including payments of the Competition Transition Charge and the Public Goods charge regardless of whether they receive payment from their end-use customer. This decision also allows energy service providers to provide for their customers meters other than those commonly furnished by the utility distribution company.

In this decision, the Commission also re-affirms the commitment in the Preferred Policy Decision (D.95-12-063 as modified by D.96-01-009) to bring the benefits of the hourly-pricing of electricity created in the Power Exchange (PX) to as many customers as possible.

Further, the means by which the Commission can ensure that energy service providers utilizing unbundled services do so in a manner consistent with Commission consumer protection rules and in accordance with established standards and protocols is articulated.

On April 29, 1996, P G&E, S D G&E, and Southern California Edison filed a Petition for a Declaratory Order, requesting that the Federal Energy Regulatory Commission confirm the delineation of certain facilities as "local distribution" based on their existing uses. The petition requested the FERC to clarify that this initial delineation can change as the uses of the facilities change and that facilities may have multiple uses.

On April 29, 1996, Pacific Gas and Electric Company, San Diego Gas & Electric Company , and Southern California Edison Company filed a Joint Application for Authorization to Convey Operational Control of Designated Jurisdictional Facilities to an Independent System Operator.

The application requests authorization to transfer operational control of certain transmission facilities to an Independent System Operator. The application describes the proposed governance and structure of the ISO, the manner in which the ISO will operate, and the transmission access and pricing rules that will apply to service over the ISO grid.

On June 13, 1996, the Public Utilities Commission of the State of California intervened in this proceeding and represented to the FERC that the CPUC would submit comments in early August, 1996, after receiving comments from the California parties on the Companies' application in this docket.
